TRANQUILO BEACH HOUSE

2024/2025

TERMS & CONDITIONS

 

1. Accommodation Capacity**:

In accordance with Coffs Harbour Council rules, our rate is designated for up to 12 guests, with a

maximum of 12 vehicles permitted overnight. Bookings can be rescheduled or transferred to another

person if needed, but payments are non-refundable.

**This is a strict policy.

** TRANQUILO BEACH

HOUSE will not allow any person other than the person named in the Booking Summary to access or

occupy the accommodation. The Booking Summary may specify the maximum permitted number of

guests who are authorized to stay in the accommodation. If you allow more than the specified agreed

maximum number of 12 people (including children) to occupy or stay at TRANQUILO BEACH HOUSE,

your rental may be terminated immediately, and all guests will have to vacate the property.

2.

**Booking Confirmation**:

- No booking is confirmed until TRANQUILO BEACH HOUSE has received both the signed Registration

Form/Terms & Conditions Agreement along with at least 50% of the booking fee. Payments are accepted

via bank transfer or credit card.

(Please note that the following surcharges apply:

Visa: 0.60% for Credit Cards, 0.25% for Debit Cards

Mastercard: 0.60% for Credit Cards, 0.25% for Debit Cards)

- (i) 50% of the booking fee is required to secure your booking.

- (ii) A $1500 deposit is required before your arrival to cover security for incidental damages, as well as a

cleaning fee of $650 will be applied to all bookings. If the client supplies their own linens. Towels, and

other essentials, the cleaning fee will be reduced to $350. The $1,500 security deposit will be refunded

within 14 days of your departure, pending a satisfactory final inspection.

- (iii) Once payment is received, you will receive a confirmation email signifying the formation between us.

(iv) Review your booking details carefully before payment, and notify us of any errors

immediately.

3.

**Lunch Guests**:

Lunch is permitted for up to 30 guests, including the 12 guests staying at TRANQUILO BEACH HOUSE.

4.

**Dinner Parties**:

Dinner parties are allowed for a maximum of 12 guests that are staying at TRANQUILO BEACH HOUSE,

plus catering staff. Music must be lowered by 9:30 PM.

5.

**Parties and Gatherings**:

- No parties or gatherings exceeding the approved number of guests are permitted. Unauthorized events

will result in immediate eviction.

- Parties are strictly prohibited. If you breach this condition or any other House Rule displayed at the

property during your stay, there will be an instant loss of bond, and you will also be evicted without notice

and without refund or credit for any nights unused.

You must not have a party or gathering without the consent of TRANQUILO BEACH HOUSE

management first being obtained.

6.

**Concierge Services**:

Full concierge services, including housekeeping, chef, and entertainment, can be arranged upon request

for additional fees.

7.

**Declining Bookings**:

TRANQUILO BEACH HOUSE reserves the right to decline any booking if misuse of the property is

suspected.

8.

**Noise Regulations**:

Noise must be minimized after 9:30 PM. Music must be directed eastward towards the ocean from the

entertainment room. Drum kits or loud amplifiers are strictly forbidden, and music machines must be kept

inside the entertainment room and facing east. If music is used by the swimming pool it needs to face the

Ocean

**Pet Policy**:

No pets are allowed on the property, excluding service animals. If you have an assistance dog, please

send your license in advance. The dog must be kept on a leash and not chase wildlife.

10.

**Camping Regulations**

No camping is allowed on this property, including caravans, camper vans, tents or 4x4 tent tops, in

accordance with council regulations. Violation of this policy will result in immediate termination of your

rental agreement, and all guests will need to vacate the property..

11.

**Maintenance Issues**:

Maintenance will be addressed during regular work hours. Requests may take longer to fulfill on

weekends and public holidays.

12.

**General Conduct**:

Guests must be mindful of their safety and follow all instructions provided by TRANQUILO BEACH

HOUSE staff.

13.

**Occupancy**:

Only guests listed on the Booking Summary may occupy the property. Unauthorized guests are

prohibited.

14.

**Property Condition**:

The property must be kept clean, tidy, and clear of rubbish. You must leave TRANQUILO BEACH HOUSE

in a fair condition as you found it.

15.

**Liability**:

TRANQUILO BEACH HOUSE is not liable for indirect losses, and liability is limited to the value of the

rental fees. You hereby indemnify TRANQUILO BEACH HOUSE and its owner in respect of any costs,

claims, liabilities, or expenses suffered or incurred by TRANQUILO BEACH HOUSE (or their agents) in

respect of any breach of these terms.

16.

**Check-In/Check-Out Times**:

Check-in is after 3 PM, and check-out is by 10 AM unless otherwise agreed in advance.17.

**Security Deposit**:

A $1500 deposit is required 7 days before your arrival to cover security for incidental damages, as well as

a $650 cleaning fee. The $1,500 security deposit will be refunded within 14 days of your departure,

pending a satisfactory final inspection.

18.

**Property Rules**:

Guests must comply with all property rules, including:

**Noise Control**: Please observe quiet hours from 9.30 PM to 8 AM. During this time, we ask that you

minimize loud noises, including music, television, and conversations.

**Smoking**: Smoking is prohibited inside the property.

**Parking**: Parking is limited to designated areas with a max of 12 vehicles overnight.

**Garbage Management**: Dispose of rubbish in designated bins; excessive garbage will incur a $150

fee.

**When vacating premises, leave the place tidy and ensure that all rubbish is removed from premises to

designated outdoor bins.

- You must not conduct any illegal or immoral activity from TRANQUILO BEACH HOUSE, nor conduct

any business or commercial activity whatsoever (retreats and team-building groups are welcome).

- You must not make any alteration or addition whatsoever to TRANQUILO BEACH HOUSE or its

contents.

- You must not use TRANQUILO BEACH HOUSE for any purpose other than personal accommodation.

(Retreats and corporate team building is permitted )

- You must not invade the privacy of TRANQUILO BEACH HOUSE or the owner nor publish or reveal

anything that might allow a third party to identify the address of the property or the identity of

TRANQUILO BEACH HOUSE (even if such information is already in the public domain).

19.

**Travel Insurance**:

Guests are strongly advised to obtain comprehensive travel insurance for unforeseen circumstances.

20.

**Guest Responsibility**:

Guests are liable for any willful loss or damage caused during their stay, with prompt reporting of

damages required.

21.

**Cancellations and Amendments (by Guest)**:

- (i) To cancel or amend your booking, notify us promptly. Cancellation or amendment will only take effect

upon written confirmation from you.

- (ii) Payments are non-refundable, but you may rebook for a later date or transfer the booking to another

person.

22.

**Cancellations and Amendments (by Us)**:

- (i) We will make every effort to honor your booking. However, due to unforeseen circumstances (e.g.,

fire, flood, maintenance issues), we may need to alter or cancel bookings.

- (ii) In case of cancellation, we will refund any amounts paid directly to us. However, we are not

responsible for third-party expenses (e.g., travel, activities).

- (iii) TRANQUILO BEACH HOUSE reserves the right to cancel a booking and issue a full refund.

- (iv) We may terminate any booking for failure to comply with the terms and conditions, in which case no

refund will be issued, and the security bond will be charged.23.

**General Terms**:

These terms represent the entire agreement and supersede any prior agreements.

24.

**Governing Laws**:

These terms are governed by the laws of New South Wales, and disputes shall be resolved in the NSW

Courts.

25.

**Complaints**:

Guests must notify TRANQUILO BEACH HOUSE of any complaints within 24 hours, allowing reasonable

time for resolution.

26.

**Arrival and Departure Instructions**:

Guests must follow access instructions provided by management and coordinate key drop-off if departing

outside office hours.

Cancellation Policy

1.

**NO REFUND POLICY**: All payments for bookings and holding fees are strictly non-refundable.

However, payments and holding fees for bookings are transferable to another available date, subject to

availability. Please note that rates may vary depending on the season. Additionally, you are permitted to

transfer your booking to a friend or relative if needed. (40 Days notification for cancellation exception

Floods and Fire)

2.

**BOOKING AND CANCELLATION**:

* **Booking**: No booking is confirmed until TRANQUILO BEACH HOUSE has received the full

payment for the booking. Payments can be made via bank transfer or credit card.

* **Payment Terms**: To hold the Property, we require you to pay 50% at the time of booking, and the

remaining 50% 40 days prior to your check-in date, to confirm your booking.

* **Security Bond** In the event of any damages or breaches, the $1,500 Security Bond may be used

to cover the cost of:

Repairing or replacing the Property, its furnishings, fixtures, and fittings

Excess cleaning required after your stay

Penalties for overstaying or breaching house rules

If the cost of damages or breaches exceeds the $1,500 Security Bond, you acknowledge that you are

liable for the additional amount and authorize TRANQUILO BEACH HOUSE to charge your credit card for

the excess amount.

Following your departure, the Security Bond will be refunded to you,within 14 Days from departure of the

property, pending a satisfactory final inspection of the property by the property owners or their

representatives following your departure.

* **Non-Refundable Cleaning Fee**: A non-refundable cleaning fee of $650 will be charged at the

time of Security Bond payment. If clients provide their own linens and towels, the cleaning fee will be

reduced to $350.

* **Confirmation of Booking**: Once the Initial Deposit or full payment has been received, you will

receive an email confirming your Booking. The contract between us will be formed when you receive the

payment confirmation email and is subject to these Booking Conditions.3.

**CANCELLATIONS AND AMENDMENTS**:

* **Cancellation by Guest**: If you need to cancel or amend your Booking, please notify us as soon

as possible. A cancellation or amendment will not take effect until we receive confirmation in writing or via

email from you. If you elect to cancel your booking, money paid is not refundable but fully transferable to

a friend or rebook at another date. (60 days notification for cancellation exception Floods and Fire)

* **Cancellation by Us**: While we strive to keep your bookings as planned, unforeseen circumstances

may occasionally require us to make alterations or, in rare cases, cancel a booking. We appreciate your

understanding in such a situation. A full refund will be issued for cancellation. If a booking is transferred to

another date, the client will not be eligible for a refund unless otherwise agreed upon by the owner.

* **Termination of Booking**: TRANQUILO BEACH HOUSE reserves the right to terminate any

booking and immediately eject any Guest from the Property for failure to comply with the Terms and

Conditions of their booking, in which case there would be no refund of any monies paid and an automatic

charging of the security bond on the Guest’s stipulated credit card.

4.

**FEES AND CHARGES**:

* **Accommodation Fees**: You agree to pay the Accommodation Fees as set out in the Booking

Summary without deduction. You also agree to discharge the cost of any damage to the Accommodation

or contents and to pay any fees in relation to overstaying or breach of house rules.

* **Additional Services**: The Accommodation Fees set out in the Confirmation of Booking are for

Accommodation only. No additional services which you may book through TRANQUILO BEACH HOUSE

are included unless stated otherwise.

* **Payment**: By accepting these terms, you agree to pay the Accommodation Fees in full and

authorize TRANQUILO BEACH HOUSE to collect the full amount referred to in the Booking Summary

immediately.

Please note that the following surcharges apply:

Visa: 0.60% for Credit Cards, 0.25% for Debit Cards

Mastercard: 0.60% for Credit Cards, 0.25% for Debit Cards

* **Currency**: All transactions are processed in Australian Dollars.

* **GST**: All fees and charges will be collected by TRANQUILO BEACH HOUSE and will be inclusive of

GST.
